Terms of Use

1. Acceptance of terms

By accessing or using Ross Command Deck ("the Service") at https://rossdeck.com, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and Ross Command Deck ("we", "us", "our"). We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Description of service

Ross Command Deck is a browser-based digital audio workstation (DAW) providing multi-track recording, MIDI sequencing, mixing, mastering, synthesis, drum programming, and related music production tools. The Service is provided on a subscription basis (monthly, annual, or lifetime) and requires a modern web browser with Web Audio API support.

3. Account registration

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate and current information during registration.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at [email protected] if you suspect unauthorised access.

4. Subscriptions and payments

Access to the full Service requires a paid subscription. Payments are processed by Stripe. By subscribing you authorise us to charge your payment method on a recurring basis (monthly or annually) until you cancel.

  • Monthly plan: billed monthly, cancel any time, access ends at period end.
  • Annual plan: billed annually, cancel any time, access ends at period end.
  • Lifetime access: one-time payment, perpetual access to the version purchased.
  • All prices are in GBP and inclusive of applicable taxes where required.
  • Refunds are considered on a case-by-case basis within 14 days of purchase.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload, transmit, or store content that infringes third-party intellectual property rights.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Use automated tools to scrape, crawl, or stress-test the Service without written permission.
  • Share your account credentials with others or resell access to the Service.
  • Upload malicious code, viruses, or any content designed to disrupt the Service.
  • Circumvent any access controls, rate limits, or security measures.

6. Your content

You retain all intellectual property rights in the music, audio, MIDI, and project files you create using the Service ("Your Content"). By saving content to cloud storage, you grant us a limited, non-exclusive licence to store and transmit Your Content solely to provide the Service.

You are solely responsible for ensuring Your Content does not infringe third-party rights (e.g. unlicensed samples). We do not claim ownership of Your Content and will not use it for any purpose other than providing the Service.

7. Intellectual property

The Service, including its software, design, audio engine, synthesiser algorithms, UI, and all associated intellectual property, is owned by Ross Command Deck and protected by copyright, trade mark, and other applicable laws. Nothing in these Terms grants you any right to use our trade marks or branding.

8. Third-party content and services

The Service integrates with Freesound (CC-licensed samples), Stripe (payments), and other third-party services. Use of third-party content is subject to the respective licences and terms of those providers. We are not responsible for third-party content or services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROSS COMMAND DECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account at any time for breach of these Terms, with or without notice. You may cancel your subscription at any time through your account settings. On termination, your right to use the Service ceases immediately. We may delete your account data after 30 days following termination.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
